I. General Terms and Conditions

§ 1 Scope

As part of this online store the following conditions shall apply between the operator Akya Arts & Services Ltd., Schwabacher Str 71a, 90763 Fürth (hereinafter referred to as AKYA) and the purchaser. Terms and conditions of the purchaser shall only be effective if they have been confirmed in writing by AKYA. The contract language is German and English.

§ 2 Offer and Conclusion of Contracts

Our offers are intended as a solicitation of an offer. The contract is concluded with the confirmation of the offer by AKYA via mail to the purchaser. All images shown in the online shop are quoted as approximate model for size and color. AKYA is entitled to cancel a contract on the Internet, if from the information provided by the purchaser or from his behaviour in the conduct of another contract with AKYA, reasonable causes let AKYA suspect that the purchaser's contractual obligations are not properly fulfilled, or if the purchaser selects prepayment and does not balance his account within 10 days. By writing or arithmetic errors AKYA is entitled to cancel the contract. There are no claims arising therefrom to the purchaser.

§ 3 Price, Payment, Invoicing and Retention of Title

All prices are in EURO including legal VAT plus costs for packaging and shipping. They are due at the conclusion of the contract immediately and without deductions. The purchaser is entitled to retention or set-off only, even if complaints or counterclaims are submitted, if AKYA have expressly agreed, or if the counterclaims are legally determined. Until the full payment of all receivables arising within the business is fulfilled, including all subsidiary, the goods remain the property of AKYA. The purchaser is not entitled to pledge the goods to third parties until full payment.

For purchasers with home or business address based in third countries outside the EU the German VAT, as far it is included in the products' information of this online store and is shown in order confirmations, is not applicable. The same applies to purchasers outside Germany but within the EU, provided that his UID is at least communicated simultaneously with his order to AKYA.

§ 4 Delivery

Delivery time is displayed at each article and begins after receipt of payment. Partial deliveries are permissible. The choice of the shipment is reserved by AKYA.

Exercise your right to cancel, you have to bear the cost of returning the goods if the delivered goods ordered and if the price of the commodity is the sum of not exceeding 40 euros or if you are at a higher price the thing at the time of withdrawal have not yet paid the consideration or a contractually agreed part payment. Otherwise, the return is free of charge.

§ 5 Warranty and Liability

Defects in the goods and damage must be reported within 7 days to AKYA in writing with a detailed defect description. In case of damages during transport, the state of the goods has to be left unchanged. For defects in the prints, which consists of improper handling of the product (especially through and wash and dry), AKYAs liability is excluded. No special characteristics of the goods are guaranteed by AKYA. Claims by the purchaser are excluded. Batteries of electric cigarettes are wearing parts, excluded from the warranty of 6 months are wear and loss of capacity. Atomizers of electric cigarettes are sold as disposable items, the warranty is thereby limited to the functional state at the time of delivery.

§ 6 Liability of the Purchaser

For own print designs the purchaser is liable alone to the full extent. This applies especially to the copyright. The purchaser releases AKYA from all claims of third parties in order to such a breach. AKYA can always demand the proof of authorization of the use of third parties' names or copyrights from the purchaser.

§ 7 Jurisdiction and Performance

As jurisdiction and performance Furth is agreed, as far as permitted.
